1. About Autoimate
Autoimate is a software platform operated by Aligned Systems Pty Ltd (ABN 70 687 465 818) of 89-97 Jones St, Ultimo NSW 2007, Australia ("we", "us", "our"). The platform provides smash repair estimating, claims management, and workflow tools for repairers, insurers, and assessors operating in the Australian smash repair industry.
2. Acceptance of Terms
By creating an account, accessing, or using the Autoimate platform, you agree to these Terms and Conditions. If you do not agree, you must not use the platform. These terms apply to all users including repairers, claims officers, assessors, and administrators.
3. User Accounts
To use Autoimate you must register for an account. You agree to:
- Provide accurate, complete, and current information during registration
- Maintain the security of your password and account credentials
- Notify us immediately of any unauthorised access to your account
- Be responsible for all activity that occurs under your account
- Not share your account credentials with any third party
We reserve the right to suspend or terminate accounts that violate these terms or are found to be inactive for an extended period.
4. Permitted Use
Autoimate is provided for legitimate smash repair industry use only. You agree to use the platform solely for:
- Creating and managing smash repair estimates and quotes
- Managing insurance claims and repair workflows
- Communicating with other authorised parties within the platform
- Uploading job-related photos and documentation
You must not use Autoimate for any unlawful purpose, to transmit false or misleading information, or in any way that could damage, disable, or impair the platform.
5. AI Estimating Tool
Autoimate includes an AI-powered estimating tool. You acknowledge and agree that:
- AI-generated estimates are suggestions only and must be reviewed and verified by a qualified, licensed estimator before submission to any insurer, repairer, or third party
- You are solely responsible for the accuracy, completeness, and compliance of any estimate submitted under your account
- Autoimate does not guarantee the accuracy of AI-generated content, including labour hours, parts pricing, repair procedures, or damage assessments
- The AI tool has been trained on historical repair data and may not reflect current OEM pricing, insurer schedule rates, or updated repair procedures for all vehicles
- AI-generated estimates do not constitute a legally binding repair quotation and must not be represented as such without independent verification by a licensed estimator
- The AI tool is designed to assist — not replace — professional judgment and expertise
- No estimate produced by the platform should be relied upon as a final assessment of vehicle damage, total loss determination, or repair cost without human review
To provide AI estimating services, job data including vehicle details, damage descriptions, and uploaded photos are transmitted to a third-party AI processing provider operating under appropriate data processing and confidentiality agreements. By using the AI estimating tool you consent to this processing.
5A. Parts Pricing
The Autoimate platform includes a parts catalogue with indicative OEM pricing. You acknowledge and agree that:
- All parts prices displayed in the platform are indicative only and are subject to change without notice
- Prices must be verified with your parts supplier or dealer before inclusion in any formal quotation or estimate
- Autoimate makes no warranty as to the accuracy, currency, or availability of any parts pricing data
- Parts pricing data is sourced from third-party suppliers and historical records and may not reflect current market pricing
- Autoimate is not liable for any loss arising from reliance on parts pricing displayed within the platform
6. Data and Content
You retain ownership of all data, estimates, photos, and content you submit to Autoimate ("Your Content"). By submitting content to the platform, you grant us a limited licence to store, process, and display that content for the purpose of providing the platform services.
You warrant that Your Content does not infringe any third-party rights and that you have the right to submit it to the platform.
7. Privacy
Your use of Autoimate is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
8. Intellectual Property
All intellectual property in the Autoimate platform — including software, design, AI models, knowledge bases, and documentation — is owned by Aligned Systems Pty Ltd. You may not copy, modify, distribute, or reverse engineer any part of the platform without our prior written consent.
9. Third Party Services
Autoimate integrates with third-party service providers for infrastructure, storage, and AI processing. These providers operate under appropriate data processing agreements. We are not responsible for the availability or performance of third-party services.
10. Limitation of Liability
To the maximum extent permitted by Australian law, Aligned Systems Pty Ltd and its directors, employees, and agents are not liable for:
- Any indirect, incidental, or consequential loss arising from your use of Autoimate
- Loss of data, revenue, or business opportunity
- Errors or inaccuracies in AI-generated estimates, labour hours, parts pricing, or repair procedures
- Any estimate accepted by an insurer, repairer, or third party based on AI-generated content produced by the platform
- Any decisions made based on information provided by the platform, including total loss determinations, repair cost assessments, or parts availability
- Loss arising from reliance on indicative parts pricing displayed within the platform
- Service interruptions, downtime, or data loss
- Any act or omission of a third-party service provider including AI processing, cloud infrastructure, or payment processing providers
Our total liability to you for any claim arising from your use of Autoimate is limited to the amount you have paid us in the three months preceding the claim, or $100 AUD, whichever is greater.
11. Disclaimer of Warranties
Autoimate is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components. Nothing in these terms excludes any guarantee or warranty that cannot be excluded under the Australian Consumer Law.
12. Termination
We may suspend or terminate your access to Autoimate at any time for any reason, including breach of these terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the platform ceases immediately. We may retain your data for a period following termination as required by law or our data retention policy.
12A. Data Retention and Photo Storage
Job photos, documents, and associated data uploaded to the platform are stored on secure cloud-based infrastructure. You acknowledge and agree that:
- Uploaded photos and job data are retained for a minimum of 12 months from the date of upload
- You may request deletion of your data at any time by contacting admin@autoimate.com
- Upon account termination we will retain your data for up to 90 days before permanent deletion, unless a longer retention period is required by law
- You are responsible for maintaining your own copies of any estimates, photos, or documents you require for legal or compliance purposes
- Photos uploaded to the platform are used solely for the purpose of generating estimates and managing repair workflows — they are not used to train AI models without your express consent
12B. Multi-User Accounts and Team Access
Autoimate supports multi-user team accounts. Where you invite team members to your account:
- You are the account owner and are responsible for all activity conducted by team members under your account
- Each team member requires a separate seat licence which is billed in addition to your base subscription
- You are responsible for removing team members promptly when they leave your business or no longer require access
- Autoimate is not liable for any activity conducted by a former team member whose access was not revoked in a timely manner
- Team member data including login credentials and activity is managed by the account owner
12C. Subscription, Billing and Cancellation
Autoimate is provided on a subscription basis. You agree to the following billing terms:
- Subscriptions are billed monthly in advance and renew automatically unless cancelled
- Additional seat licences for team members are charged at the current per-seat rate and billed immediately upon addition
- Seat licences that are removed will reduce your next billing cycle — no partial refunds are issued for seats removed mid-cycle
- You may cancel your subscription at any time through the platform settings — cancellation takes effect at the end of the current billing period
- No refunds are issued for unused portions of a subscription period
- We reserve the right to change subscription pricing with 30 days written notice to registered account owners
- Failure to pay may result in suspension of your account and loss of access to your data until payment is made
13. Changes to These Terms
We may update these Terms and Conditions from time to time. We will notify registered users of material changes by email or through the platform. Continued use of Autoimate after changes are posted constitutes acceptance of the updated terms.
14. Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes arising from these terms or your use of Autoimate will be subject to the exclusive jurisdiction of the courts of New South Wales.
